Lawsuit Update

Today, Wisconsin Dairy Alliance and Venture Dairy Cooperative, represented by the WMC Litigation Center, filed a lawsuit against the Wisconsin DNR challenging its presumption that CAFOs are polluters. 

 

  • The lawsuit is asking the DNR to follow the law.

  • The case is about legal issues only; CAFOs can’t pollute now and won’t be able to pollute after this lawsuit.

  • DNR presumes CAFOs are guilty of polluting and that is just not the case; two federal courts agree that you cannot presume pollution.

  • This lawsuit would bring DNR consistent with federal law, as state law already requires.
